Estate planning is crucial in the organization of your personal affairs.  It is important to recognize that dying without a Will (also known as “intestate”) can result in additional burden and stress on your family, as it can be time consuming, costly and cause delays in the distribution of your estate.  It means that the Courts will use provincial laws to decide how to distribute your assets, in addition to appointing an executor and guardians for any minor children. Unfortunately, this often is not what you would have chosen.

It should also be noted that common-law spouses and other loved-ones can often be left vulnerable if you die intestate, as those relationships are not always accounted for in the provincial rules.

A Power of Attorney for Property is also very important to ensure that your financial affairs will be administered in the event of your absence or disability and a Power of Attorney for Personal Care will provide for decision making in the unfortunate event that you are incapable of making appropriate decisions for your own personal care.
